SF PRIDE TERMS OF SERVICE & CODE OF CONDUCT

1. Scope and Acceptance of Terms

1.1 Parties and Agreement

These Terms of Service (the “Terms”) constitute a legally binding agreement between San Francisco Pride, Inc., a California nonprofit corporation (“SF Pride,” “we,” “us,” or “our”), and any User (as defined below). By accessing, using, or registering for any SF Pride service, membership, event, or property (including the annual Parade and Festival), the User agrees to be bound by these Terms, the SF Pride Privacy Policy, and all applicable federal, state, and local laws.

1.2 Definition of Users

2.1 General Code of Conduct

All Users must adhere to the following Code of Conduct. Failure to comply may result in immediate removal from the event site, revocation of participation/membership status, and referral to law enforcement.

2.3 Assumption of Risk (Liability Waiver)

By attending the Parade or Festival, the Attendee or Participant acknowledges and assumes all risks and hazards associated with being on the premises or participating in the event. This includes, but is not limited to, risks of property damage, personal injury, illness (including communicable diseases like COVID-19), or death. The Attendee or Participant, on behalf of themselves and their personal representatives, releases, waives, discharges, and covenants not to sue SF Pride, its officers, directors, staff, or sponsors from any and all liability for any loss, damage, or injury arising from attendance or participation.


3. Commercial Activity and Intellectual Property

4. Non-Profit Membership Terms (Members)

4.1 Eligibility and Dues

Membership is granted solely at the discretion of the SF Pride Board of Directors. Members must pay annual dues as set by the Board. Failure to pay dues or maintain eligibility criteria will result in the immediate termination of membership.

6.1 Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or the SF Pride events shall be exclusively brought in the state or federal courts located in the City and County of San Francisco, California.

6.2 Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed from the Terms, and the remaining provisions shall continue in full force and effect.

6.3 Modifications

SF Pride reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the official SF Pride website. Continued use of SF Pride services, participation in events, or maintenance of membership constitutes acceptance of the modified Terms.
